1) I acknowledge that running and walking involves the real risk of injury or death from various causes, which may include but are not limited to: overexertion; dehydration; heart problems; disorientation; accidents with other competitors, spectators, volunteers or road users; equipment failure; unforeseen events; the course; or weather conditions.

2) I assume all risks associated with competing in the Race Hub Australia event, including, but not limited to, slips, falls, contact with other participants, negligent acts of other participants, any defects or condition of premises, the effects of the weather including high heat, cold temperatures, storms and/or humidity. All such risks being known, assumed and appreciated by me.

3) I accept full responsibility for informing myself and assessing all the dangers, hazards and risks of entry in the event, and will rely solely on my own assessment of these dangers, hazards and risks before participating in the event, and notwithstanding any decision thereon made by Race Hub Australia and/or other persons corporations and bodies involved in promoting or staging the event. The decision to participate in the event is entirely my own and I accept all risks associated with participation in the event, including but not limited to loss of life and/or any injury (including any permanent injury).

4) I recognise and acknowledge that Race Hub Australia have applied as many procedures in place to offer a safe running experience, there are certain risks of physical injury to participants, and I voluntarily and knowingly agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that I may sustain as a result of said participation.

5) I confirm that I am physically fit and that I have sufficiently trained for participation in the Event and have not been advised otherwise by a qualified medical person that I cannot participate in the Event. I acknowledge that I must, and I agree that I will, disclose to Race Hub Australia any pre‐existing medical or other condition that may affect the risk that either I or any other person will suffer injury, loss or damage as soon as I become aware of such condition.

6) I consent to receiving any medical treatment that Race Hub Australia or medical or paramedical personnel believe is necessary for my health, before, during, or after the event, including any required transportation in order to obtain required treatment in the event of injury to me as medical professionals may deem appropriate. I understand that Race Hub Australia reserves the right to remove me from the event if I am showing signs of distress, considers I am doing myself harm, or if it is unsafe for me to continue the race.

7) I understand that the Race Hub Australia does not provide health insurance for me, and I will bear all financial responsibility for all and any medical treatment arising from my participation in this event; including but not limited to ambulance, doctor, and hospital fees. I understand that I should have my own personal accident and ambulance cover.

8) I understand that I must follow the approved course, observe normal traffic rules and obey all directions and instructions given by Race Hub Australia, Event Officials and Police.

9) I acknowledge that when participating in a Race Hub Australia event, I must wear the official bib corresponding to the registration made in my name on my chest such that the allotted race number, start group and sponsor names on the face of the bib can be seen for the duration of the Event. A timing tag is attached to the back of the race bib to enable each Participant’s run to be timed. Participants must not tamper with the timing tag attached to their race bib. Timing services are provided by third party contracted timing service providers, and Race Hub Australia takes no responsibility for errors or omissions in the timing data. By participating in the Event and wearing the race bib, each Participant consents to Race Hub Australia and the timing service provider collecting and publishing his or her timing data for the Event. The Participant understands that starting the race before his or her assigned wave start time will result in disqualification.

10) No roller skates, roller blades, hand cycles, geared vehicles, skateboards, bicycles, scooters, dogs, balls or other accessories that could cause injury will be permitted at the Event.

11) None of our current events allow wheelchair or hand cycle users due to terrain and event village locations. As an inclusive organisation, Race Hub Australia will endeavor to make our events more friendly to all.

12) Spectators may not follow competitors on foot (Parents of children in the 2k event exception), bikes, in vehicles or via any other mode of transportation.

13) The use of any type of drone is prohibited at the Event.

14) I agree that registration in the Event is personal to me and that no other person is permitted to participate in the Event in my place without authorisation from Race Hub Australia

15) I understand that should my contact details change after my registration has been completed, it will be my responsibility to notify Race Hub Australia.

16) Each competitor must assemble behind the designated starting line, await official start and then proceed on the approved Event course. I acknowledge that entry into the Event course after the indicated cut-off time or prior to the official start will result in disqualification.

17) The only vehicles permitted to lead or follow the event are Police and Official cars.

18) I agree that all decisions of Race Hub Australia are final. Race Hub Australia is the sole judge of fact; there is no right of appeal regarding any decision made by Race Hub Australia.

19) I assume risk of animals and insects that may be present on the course.

20) I understand that I must not distribute, communicate or disseminate any material or information or message on any medium or platform (whether online or offline) which may damage, defame or otherwise negatively affect the reputation of Race Hub Australia.

22) I consent to the publication and/or use in any form of media whatsoever of my name, race result, image, voice, statement or otherwise, (including the publication of my name and/or Event result, suburb and applicable age bracket in any media publication and/or on the Event website) without any payment or compensation to me. I also consent to the use of my image and/or voice in any form of media whatsoever by the Council for the purposes of promoting the Event and/or other events operated or managed by Council without any payment or compensation to me.

23) I agree that Race Hub Australia is not responsible for any personal items or property that are lost, stolen, stained or damaged at the event. The participant is fully responsible for the security of their personal possessions at the event. Race Hub Australia will not be held responsible for lost or stolen valuables.

24) Race Hub Australia reserves the right to inspect any bag or other attachment to or accompaniment of a participant at any time while the Participant is participating in the Event including at the starting line and finishing line areas.

25) I acknowledge that Race Hub Australia retains the sole discretion to withdraw me from the Event at any stage should my equipment become unusable or be deemed as unsafe and/or unfit for use.

26) The minimum age required to enter is 12 years old for a 10k and 15 years old for a half marathon. Any children or minors under 18, entered into kids races or races involving children by adults or guardians is done so at the adult or guardians own risk.

27) I will not at any stage before or during the Event consume alcohol or any mind-altering substances. I understand and acknowledge the dangers associated with the consumption of alcohol or any mind‐altering substances before or during the Event. I accept full responsibility for any injury, loss or damage associated with the consumption of alcohol or any other mind‐altering substance. I accept that Race Hub Australia retains the sole discretion to deny my participation in the Event due to actual or reasonably suspected consumption of alcohol or any mind-altering substances.

28) I understand that entry fees are non-refundable for non-starters and non-finishers. Entry fees are fully refundable minus a $10 admin fee for withdrawals prior to 14 days before the day of the event. No refunds will be provided for merchandise purchases.

29) It is possible to transfer your entry to a friend or family member up to 3 days before the event date. Please get in touch with [email protected] with your name and ‘Bib Transfer’ in the subject line.

30) It is possible for a participant to change event distances up to 3 days before the event date. No refunds for a downgrade in course distance will be made. Course upgrades will incur the difference in entry fee. Please get in touch with [email protected] with your name and ‘Event Transfer’ in the subject line.

31) If, the Event is delayed, modified, or postponed for any reason, including but not limited to acts of God or the elements (including without limitation, wind, rough water, rain, hail, hurricane, tornado, earthquake), government “stay at home” orders, acts of terrorism, fire, threatened or actual strike, labour difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, race course conditions, or any other cause beyond the control of Race Hub Australia, entries will be automatically transferred to a new date once agreed with the relevant councils.

32) The organisers hold the rights to amend/cancel any event at late notice. If, the Event is cancelled without an option to reschedule, including but not limited to acts of God or the elements (including without limitation, wind, rough water, rain, hail, hurricane, tornado, earthquake), government “stay at home” orders, acts of terrorism, fire, threatened or actual strike, labour difficulty, work stoppage, insurrection, war, public disaster, flood, unavoidable casualty, race course conditions, or any other cause beyond the control of Race Hub Australia, there may be a pro rata refund of any participant entry fees paid once all committed contractors are paid. Where an event is not fully cancelled or rescheduled and the participant chooses not to race, they will not be entitled to a refund.

33) Promotional codes may only be used where the Participant meets the conditions applying to the code and uses it within the validity period. Promotional codes are not able to be redeemed or exchanged for cash and must only be used by the Participant(s) to whom the relevant code was issued to by the code owner. Promotional codes may not be used in conjunction with any other offer.

34) Race Hub Australia has the right to modify, suspend and/or cancel any promotional code at any time without notice to Participants. No refunds will be made to Participants who have access to a promotional code but who do not use the code at the time of registration and purchase.

35) Only entries submitted through the official online registration system will be accepted prior to race day. The information on how to enter and the details about the Event forms part of these Event terms and conditions. The number of entrants will be strictly limited and will be decided on the basis of first received or until registrations close.

36) When entering on the day of an event, in person, by confirming your full name, DOB and email address you understand that you are agreeing to our full terms and conditions and waiver.

37) You agree to receive Race Hub Australia emails with details of our events. You may receive emails from our sponsors if it is related to the event. Your emails will not be passed onto third parties unrelated to the event unless requested. You can unsubscribe at any time but may miss on important information related to the event.

38) You agree that registration in the Event is valid for the Event only, and cannot be transferred or deferred to future events without the authorisation of Race Hub Australia.

39) You acknowledge that I will write an emergency contact name and phone number in the space provided on my supplied race bib and agree that Race Hub Australia may contact that person and exchange my personal information with them in case of an emergency.

40) I agree that my entry information will be collected into a database for the purpose of the event which is and shall remain the property of Race Hub Australia.

41) I consent to Race Hub Australia using my personal details in my registration form for the administration of the Event and by any third parties selected by me during the registration process, including to SMS and/or email information about the Event to me, unless otherwise indicated by me during the online registration process. I also consent to my personal details being used by Race Hub Australia and its related bodies corporate for future marketing and promotional purposes.

42) When registering for an event, all participants are agreeing to abide by our code of conduct at all Race Hub Australia events. All decisions about appropriate or inappropriate behaviour are at the sole discretion of the event organisers at Race Hub Australia.

43) I acknowledge that Race Hub Australia and/or its representative may remove me from the Event area and/or exclude me from participation in the Event if it is necessary to do so: (a) due to my behaviour being inappropriate, offensive, or abusive; (b) to prevent damage to any property; (c) on medical, health and/or safety grounds (including to prevent possible harm or injury to myself and/or any other person); and/or (d) to prevent or arrest any form of unauthorised marketing, including ambush marketing.

44) I acknowledge and consent to the possibility of being photographed and/or videotaped during the event. Race Hub Australia reserves the right to capture and use images, audio, and video recordings for promotional and informational purposes, including but not limited to, marketing materials, social media, and our official website.

45) Race Hub Australia will endeavor to advise participants of any change to this waiver prior to the event, but any such change shall be considered effective for all participants, whether or not the participant has received notice of the change prior to the event.

I declare that all the information supplied by me in the registration process is true and correct. I fully understand its terms and that I agree to abide by those terms above. I signed the waiver document freely and voluntarily without any inducement made to me and intend my signature or other acknowledgement to be a complete and unconditional release of all liability to the greatest extent allowed by law.
